The following terms and conditions govern your use of the Apple iPhone 3G on the Rogers network. They supplement and are incorporated into the Rogers Terms of Service, which are available at rogers.com/terms, and form part of our Wireless Service Agreement with you. Capitalized terms below have the meanings given to them in the Rogers Terms of Service or the Wireless Service Agreement. Amounts below do not include applicable taxes.
Visual Voicemail
With Visual Voicemail, there are two ways to retrieve your voicemail messages:
Data Usage
Your iPhone will be enabled for data usage. If you subscribe to a plan with no data included, you will be prompted to purchase a pay-per-use Data Day Pass any time you attempt to use a service that requires data to be sent and/or received over the Rogers network, unless you subscribe to a monthly Data add-on, which we highly recommend. The data allowances included with the iPhone plans are only intended for data usage on the iPhone and do not apply to usage on any other device.
Roaming
Some data charges may be incurred if your iPhone is taken out of Canada even if there has been no user initiated data activity. This is because your iPhone interacts automatically with the data network to update and synchronize your data services on a near real-time basis (i.e. to check for new e-mail messages). Voice and data usage while roaming, including data usage incurred from delivery of Visual Voicemail messages, will be charged at our regular roaming rates. Visit rogers.com/roaming for our roaming rates and destinations. You can also subscribe to a Data add-on, Data Roaming add-on or Data Travel Pack to save on data charges. If you want to avoid data charges while traveling, please ensure that the Data Roaming toggle on your iPhone is set toOFF, which will block data roaming when the iPhone is outside Canada. Data usage is measured and charged in KB rounded to the next full KB in the US, and rounded to the next 20KB internationally.
Hotspots WiFi
If you subscribe to an iPhone Voice & Data Package, then you will have WiFi access to Rogers and Fido Hotspots without incurring additional usage charges while using your iPhone. For the Rogers and Fido Hotspots footprint, please go to rogers.com/hotspots.
Important Note to Existing Rogers Wireless Customers
If you are an existing Rogers Wireless customer and have subscribed to a new iPhone Voice & Data Package, please note the following:
Unauthorized modification to iPhone
Your iPhone is restricted to use on the Rogers network, unless you are roaming. If you attempt to unlock your iPhone and use it on another network, it may become permanently unusable. Making unauthorized modifications to the software on your iPhone violates the iPhone software license agreement, and any resulting inability to use your iPhone is not covered under your iPhones warranty.
Data Early Cancellation Fee
In connection with your Rogers Vision Wireless data service, a Data Early Cancellation Fee (DECF) also applies if, for any reason, your service is terminated prior to the end of your plans commitment term (Data Term). The DECF is the greater of (i) $25 or (ii) $5 per month remaining in the Data Term, to a maximum of $100 (plus applicable taxes), and applies in addition to the ECF for termination of your service agreement. If you subscribe to a plan combining both voice and data services, both the ECF and the DECF will apply.
